नमक मिर्च और पेट्रोल डाल कर पुलिस ने की पिटाई। मानवाधिकार आयोग ने किया ये कार्यवाही

मामला झारखण्ड के सरायकेला अंतर्गत राजनगर थाने की है जहा पर पुलिस ने एक निर्दोष बनकाटी गाँव के निवासी बिरेन्द्र मंडल को 10 नवम्बर को हिरासत में ले कर थाना लाया और प्रज्ञा केंद्र में चोरी का आरोप  जबरन कबूल करने का दबाव बनाने लगा नहीं कबूल करने पर उसके बदन से सारे कपडे खोल दिए गए और बेरहमी से नमक मिर्च और पेट्रोल डाल डाल कर उसकी पिटाई की गई। इस पिटाई से बीरेंद्र अधमरा से हो गया था काफी बुरा हाल देखते हुए पुलिस ने उसे अस्पताल में भर्ती करवाया 5 दिनों की पिटाई के बाद उसे यह कहते हुए छोड़ा गया की वह किसी को इस बात की जानकारी नहीं देगा और मामले में किसी को कुछ नहीं बताएगा। यह खबर देनिक जागरण अख़बार में दिनांक 16 नवम्बर 2017 को प्रकाशित की गई। इस मामले को गम्भीरता से लेते हुए मानवाधिकार कार्यकर्ता ओंकार विश्वकर्मा ने मानवाधिकार आयोग से लिखित शिकायत दर्ज करवाये थे जो मानवाधिकार आयोग वाद संख्या 1481/34/20/2017 दर्ज था।जिस पर आयोग ने संज्ञान लेते हुए झारखंड सरकार मुख्य सचिव को 2 लाख रुपया मुआवजा भुगतान का आर्डर किया।

he complainant has stated that the victim has been brutally, physically tortured in the police custody for five days since 10.1.2017. Hence, the complainant has sought intervention of the Commission. The Commission took cognizance in the matter on 07.12.2017 and directed to transmit a copy of the complaint to the concerned authorities calling for an action taken report within four weeks. Pursuant to the directions of the Commission, the SP, Saraikela-Kharsawa, has filed his report dated 12.03.2018 along with the report of SDPO, Chandil, dated 03.02.2018. The reports reveals that the allegation of beating has come, on the then SHO of Police Station Rajnagar and allegations against other officials could not be substantiated. The then SHO of Police Station Rajnagar has been sent to Police Lines by removing him from the post of SHO, Police Station Rajnagar. The victim Shri Virender Mondal was already injured, but his medical examination was not got conducted, which shows the misconduct and negligence on the part of the then SHO Police Station Rajnagar. If the victim could have been medically examined before bringing the victim / accused to the Police Station, the situation would have been clear. The then SHO Police Station Rajnagar has also not recorded this fact in the Daily Diary. Hence, the then SHO Rajnagar, is found guilty of misconduct and the departmental proceeding has been recommended against him. The Commission has considered the reports. In view of the reports, the then SHO Police Station Rajnagar has been found guilty of misconduct and negligence and the of departmental proceeding against him has also been recommended. In this way the human rights of the victim Shri Virender Mondal has been violated and the victim is liable to be compensated for the violation of his human rights as the State is vicariously liable for action or inaction of its employees. Therefore, the Commission directs its Registry to issue a show cause notice to the Chief Secretary, Government of Jharkhand, calling upon him to show cause as to why monetary compensation of Rs 2,00,000./- only (Rupees Two Lakhs only) should not be recommended U/S 18 (a) (i) of Protection of Human Rights Act, 1993, to be paid to the victim Shri Virender Mondal for violation of his human rights. The Chief Secretary, Government of Jharkhand, is directed to submit compliance report alongwith proof of payment within eight weeks.
