Direction issued by the Commission The Complainant, Ms. Vandana Chandravanshi, a human rights activist, in her complaint, which is received in the Commission on 04 December 2014, has drawn attention of the Commission to an incident, which occurred at Pandra (Nirsa) village, Dhanbad, Jharkhand, where three girl students fell ill after consuming the mid-day meal in the School. In response to the Commission's directions, the Deputy Secretary, Department of School Education and Literacy, Government of Jharkhand, has sent a report, wherein it was reported that on the date of incident, 63 girls had taken mid-day meal, but only three girls complained of abdominal pain. They were given first aid in the local health sub-center. The problem of the girls is not attributable to the mid-day meal. Having considered the report, the Commission, vide speed post dated 16 February 2017, got transmitted a copy of the report to the Complainant for her comments, if any. In response, the Complainant sent her comments dated 15 April 2017, wherein it was stated that in his report, the District Education Superintendent had admitted that the children were sent to the Primary Health Centre, but he has not sent any evidence. From perusal of the report, it appears that the children were not sent to the Primary Health Centre. The ailing three children be paid a compensation of Rs. 2,00,000/- each. A copy of the comments of the Complainant was sent to the authority concerned. In response, the Deputy Commissioner, Dhanbad, vide communication dated 26 May 2018, has forwarded a report dated 16 May 2018 of the District Education Superintendent, Dhanbad, along with other reports enclosed with it. As per the report, after taking the mid-day meal, the three girls had complaint of stomach ache and they were taken to the Primary Health Centre, Nirsa, where they were examined by the doctor, who found that they were not suffering from stomach ache at that time. He asked them to go to their homes. A letter to this effect is attached with the report. It is further stated that the said girls are not continuing with the studies in this school at present. The Commission has considered the report. The doctor, who treated the said girls, has stated that they were not suffering from stomach ache when they reached to the Primary Health Centre, as such, he advised them to go to their homes. Since there was no violation of human rights of the children, no further intervention of the Commission is required and the case is closed.
