After breaking the leg in police beating of Shankar's body, order of one lakh rupees compensation to the Chief Secretary

Sir/Madam,
 
         The complaint dated 30/01/2018, received from ONKAR VISHWKARMA, HUMAN RIGHT ACTIVIST in respect of SHANKAR SAV, was placed before the Commission on 23/07/2020. Upon perusing the complaint, the Commission directed as follows:
 
 
          The substance of the complaint dated 30.01.2018, by activist Omkar Vishwakarma from Koderma, Jharkhand, is that, on 28.01.2018 a victim named Shankar Sao s/o Laxman Sao, a resident of Tintara village under Koderma PS was taken to the police custody by the local police and he was subjected to torture; as a result, the victim sustained a fracture injury on his leg. Though, he was taken to the Koderma Hospital for treatment, but the victim was unable to walk. Thus, alleging violation of the human rights of the victim by the police, the complainant has sought the intervention of the Commission for necessary action against the erring police officials and adequate compensation to the victim.

The Commission vide proceedings dated 31.12.2019, after examining the materials on records, found that, there was strong prima facie evidence of violation of human rights of the victim by the concerned erring police officials and accordingly, the Commission issued show cause notice u/s 18 (a) (i) of PHR Act, 1993, to the State of Jharkhand through its Chief Secretary to show cause as to why the Commission should not recommend Compensation of Rs.1,00,000/- (One lakh) to be paid to the victim,  Shankar Sao, within six weeks.

Despite sufficient opportunity having been afforded to the State, no response has been received. It appears that, the State has nothing to offer to the show cause notice. In the circumstances, the Commission recommends to the State of Jharkhand to pay compensation of Rs.1,00,000/- (one lakh only) to the victim, Shankar Sao s/o laxman  Sao.

The Chief Secretary, Govt of Jharkhand, is directed to ensure necessary payment to the victim an send  compliance report, at the earliest. With this direction the matter requires no further intervention at the end of the Commission. Hence, the case is closed.
 
 
2.         Accordingly, I am attaching scanned copy of the complaint for necessary action as per the directions of the Commission.
